Fees

(a) The Client agrees to pay fees to the Company according to the payment schedule set forth on the Company’s website, or otherwise provided to the Client, and the payment plan selected by the Client (the “Fee”).

Monthly/Bi-Weekly Subscription: By purchasing a Monthly Subscription, you agree to an initial and recurring Monthly/Bi-weekly Subscription fee at the then-current Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your Subscription at any time, subject to the terms of our cancellation policy. 

AUTOMATIC MONTHLY/Bi-weekly RENEWAL TERMS: Once you subscribe and transaction has been completed successfully, AXEN Fitness will automatically process your Monthly and/or bi-weekly Subscription fee in the next billing cycle. AXEN will continue to automatically process your Monthly Subscription fee each month and/or bi-weekly at the Subscription rate you sign up with, until you cancel your subscription. We explain how to cancel your Axen Fitness Subscription below at the Section "Cancellation Policy".

Cancellation Policy: You may cancel your Subscription at any time by contacting us directly via Online Chat, contacting your coach directly or by email. If you need help, feel free to contact us anytime. If you cancel your Subscription, the cancellation will take effect for your next billing cycle. You will not be eligible for a refund for subscription fees paid prior to the last payment that the cancellation takes effect.  All service payments are NON-refundable on processes. 

Please note that if you decide to cancel with us your access to Elite Trainr and to any of our services will be deactivated. We do have a Monthly option for clients to access their plans and the Elite Trainer App however no updates will be made to your personalized plans. 

Due to increases in prices and keeping the quality of our services, if a member cancels and decides upon rejoining the team in the future they will have to subscribe to the updated coaching plan prices and/or gym current gym membership prices. NO EXCEPTIONS WILL BE MADE. 

Billing & Payments (Updates & Failed Payments): You are responsible for providing valid and current payment information and You agree to promptly update your Account information, including payment information, with any changes that may occur (for example, a change in Your billing address or credit card expiration date). If You fail to pay your Subscription Charges or any other charges indicated within 3 payments attempts  (3) days of your subscription agreement that payment is delinquent, or if you do not update payment information upon our request, in addition to our other remedies, We may suspend access to and use of the services by you and your accounts will be deactivated. If you wish to re-join you will be required to pay any outstanding balances and will have to subscribe to the updated/current plan prices. 

 

ADMINISTRATION FEES:

  1.  An NSF/Admin charge of $25.00 CAN  is applicable to all returned/failed payment attempts. 
  1. Upon payment default, we may declare the whole or any part of the balance of Recurring Dues for the duration of the Minimum Term, to be immediately due and payable.


Refunds

(a) Upon execution of this Agreement, the Client agrees to pay to the Company the full amount of the Fee.

(b) If the Client cancels and/or misses attendance at, or participation in, any services provided for any reason whatsoever, the Client will not be entitled to receive a refund.

Appointment/Check-in Cancellation: When you book your appointment or check in, you are holding a space on our calendar that is no longer available to our other clients. In order to be respectful of your fellow team members, please use our support chat via our website or contact your personal coach as soon as you know you will not be able to make your appointment.

If cancellation is necessary, we require that you contact us 24 hours in advance. Appointments are in high demand, and your advanced notice will allow another client access to that appointment time.

How to Cancel Your Appointment: If you need to cancel your appointment, please contact us directly as soon as you can.  Please use our support chat via our website or contact your personal coach.

Late for Check-Ins / Missed Check-in: If you are late for a check-in it will not go over your allotted check-in time. Typically our check-ins are 30 mins at a time and will stay within that agreed/scheduled time-frame. If you miss your check-in without prior notice to your coach you will not have the option to reschedule and will have to wait for your next scheduled frequency check-in appointment. 

Late Cancellations/No-Shows ( Personal Training Sessions) : A cancellation is considered late when the appointment is canceled less than hours before the appointed time. A no-show is when a client misses an appointment without canceling. In either case, we will charge the client the full charge of the missed appointment. Both a no show or late cancellation will result in a full charge. 

Cancellation Policy (Events and Classes): Our venue holds limited space, and many of our [Events/Classes] sell out. For this reason, we request that you cancel at least 24 hours before your scheduled [Event/Class]. This will allow us to offer your spot to another client. You may contact us at AXENFITNESS.COM to cancel. Please note, we do not offer refunds for classes or events.


MODIFICATIONS TO POLICY & TERMS
We may change the Agreement or these Terms of Use at any time for any reason by updating this posting. You are responsible for periodically reviewing these Terms of Use for revisions. Changes in the Terms of Use will be effective when posted. If AXEN makes a material change, AXEN will notify you here in this Terms of Use Agreement or by any other means we deem appropriate. AXEN may determine, in its sole discretion, in good faith, what constitutes a "material change" using common sense and reasonable judgment. Your use of the Site or any of the AXEN Services after we have modified this posting will constitute your acceptance of any changes.

•Payments are paid in a subscription format so once you make your first payment you will be automatically charged at the frequency of choice of payment. 
•If you are not satisfied with the services at Axen and would like to cancel it is up to you to inform us 14 days prior to cancelation of next payment if it’s past the commitment obligation.  If not,  you are required to make payments until the MINIMUM commitment term is completed.  
•Some extra charges may apply specifically to competition athletes to help cover travel accommodations, tickets and backstage passes if the competition is out of town and wish to have a coach attend. HOWEVER, you will be notified prior to the competition.

FACILITY PROTOCOL & ETIQUETTE 

Welcome to AXEN FITNESS! Before you get started, read through our facility protocols, expected etiquette, and a few tips on how to make your workouts worth it. Protocols may change from time to time. We aim to create an open, comfortable and welcoming space for all!

HOURS OF OPERATION: We’re open long hours for the early birds and night owls as we are 24/7 to all gym membership holders. Staffed facility hours are posted and available online at www.axefitness.com, google or displayed outside the facility. Staffed facility hours vary and may change subject to public response. During hours of staffed operation, you may find that some times are busier than others due to our appointment based schedule, and it is up to you to decide when you would like to visit the facility to see coaches and staff.  You may reach out to use via our online chat or via social media chats.

PARKING: There is plenty of parking available free of charge. We are not responsible for any damaged or stolen property. 

EXERCISE CLOTHING & HYGIENE: Clean, appropriate athletic clothes and footwear that will not restrict freedom of movement are required for the exercise floor. For the purposes of safety, hygiene, and environment, the following are NOT ALLOWED on the exercise floor: barefeet, sandals and you are REQUIRED to wear a shirt. 


GUEST PRIVILEGES: A member with guests may bring guests during any facility visit however will require to pay the applicable drop in fee. (If coming during un-staffed hours please let us know ahead of time via our online chat). The guest must be with the member when they check into the facility. A member may not walk in to check in a guest and then leave the club while the guest uses the facility. All guests must be 18 or older during un-staffed hours and MUST sign a liability waiver. Guests must be 18 years of age or older, unless the guest is a legal dependent, in which case they may be a minimum 12 years of age with signed consent. 

ETIQUETTE : We aim to allow members to have free reign of the space with some limitations. 

  1. Staff Only Areas. No members are permitted to go behind the protein shake bar. There is a filtered water dispenser by the cardio equipment and two generously spacious restrooms with showers available 24/7. 
  2. No rough housing is permitted at any time. 
  3. There is no alcohol, vapes, or smoking within the facility. 
  4. Dress for success. Ensure as a member you are wearing Indoor footwear & workout attire. 
  5. Replace weights and other equipment. After using weights or other equipment, be sure to put them back where they belong. This helps keep the gym tidy and ensures that others can easily find what they need.
  6. Ask for help if needed- If you're unsure how to use a particular piece of equipment or have a question or concern don't be afraid to ask one of our friendly gym team members for help. They'll be more than happy to show you how to use the equipment safely and effectively.
